Terms of Service

These Terms of Service ("Terms") govern your use of lawn care services provided by Lawn Care Austin TX ("Company," "we," "our," or "us"). By engaging our services, you ("Customer," "you," or "your") agree to be bound by these Terms.

1. Services

1.1 Service Description

We provide professional lawn care services including, but not limited to, lawn mowing, maintenance, fertilization, weed control, aeration, overseeding, seasonal cleanup, and related services as described on our website and in service agreements.

1.2 Service Scheduling

Services are scheduled based on weather conditions, equipment availability, and crew routing. While we strive to maintain consistent schedules, service days may vary due to weather, equipment issues, or other factors beyond our control. We will make reasonable efforts to notify customers of significant schedule changes.

1.3 Service Modifications

We reserve the right to modify, suspend, or discontinue any service at any time. Customers will be notified of significant changes to services they have scheduled.

2. Customer Responsibilities

2.1 Property Access

Customer agrees to provide clear, safe access to the property for service. This includes:

• Ensuring gates are unlocked or providing gate codes
• Removing obstacles such as toys, hoses, or decorations from lawn areas
• Securing pets during scheduled service times
• Marking or identifying sprinkler heads and underground utilities

2.2 Property Condition

Customer is responsible for informing us of any hazards on the property including, but not limited to, underground utilities, shallow sprinkler lines, concealed obstacles, or areas requiring special care. We are not liable for damage to items not properly marked or disclosed.

2.3 Accurate Information

Customer agrees to provide accurate contact information, property details, and service requirements. Changes to contact information or service requirements should be communicated promptly.

3. Pricing and Payment

3.1 Pricing

Service pricing is based on property size, service type, frequency, and current conditions. Quoted prices are estimates and may be adjusted if actual property conditions differ significantly from initial assessment. We reserve the right to adjust pricing with 30 days notice for recurring services.

3.2 Payment Terms

Payment is due upon completion of service unless other arrangements have been made. We accept cash, checks, credit cards, and ACH transfers. Invoices not paid within 30 days are subject to a late fee of 1.5% per month or the maximum allowed by law, whichever is less.

3.3 Non-Payment

We reserve the right to suspend services for accounts with past-due balances. Customer is responsible for all costs of collection including reasonable attorney fees if legal action becomes necessary.

4. Service Commitment and Cancellation

4.1 No Long-Term Contracts

We do not require long-term contracts for most services. Customers may cancel recurring services at any time with notice. Some specialized programs (such as annual fertilization plans) may have specific terms outlined in separate agreements.

4.2 Service Cancellation by Customer

Customers may cancel or reschedule individual service visits by contacting us at least 24 hours in advance. Last-minute cancellations may result in a trip charge if crews are already en route.

4.3 Service Cancellation by Company

We reserve the right to cancel or refuse service for any property where conditions are unsafe, access is not provided, payment is past due, or for any other reasonable cause. We will provide notice when practical.

5. Liability and Warranties

5.1 Satisfaction Guarantee

We stand behind our work with a satisfaction guarantee. If you are not satisfied with any service, notify us within 48 hours and we will return to address the issue at no additional charge.

5.2 Limitation of Liability

We carry general liability insurance and take reasonable care in providing services. Our liability is limited to the amount paid for the specific service in question. We are not liable for:

• Damage to unmarked or undisclosed sprinkler systems, utilities, or underground features
• Damage caused by pre-existing property conditions or defects
• Natural lawn conditions including weeds, disease, or drought stress not addressed by contracted services
• Consequential or indirect damages
• Results affected by factors beyond our control (weather, soil conditions, irrigation issues, etc.)

5.3 Service Results

While we strive for excellent results, lawn care involves many variables beyond our control. We do not guarantee specific results from fertilization, weed control, or other treatments, as outcomes depend on weather, soil conditions, irrigation, and other factors we cannot control.

5.4 Claims

Any claims for damage must be reported within 48 hours of service. We will investigate all reasonable claims and work to resolve issues fairly.

6. Weather and Service Delays

Services may be delayed or rescheduled due to weather conditions including rain, extreme heat, or other circumstances that make service unsafe or ineffective. We will reschedule weather-delayed services as soon as conditions permit. No refunds or credits are provided for weather delays.

7. Intellectual Property

All content on our website including text, graphics, logos, and images is the property of Lawn Care Austin TX or its licensors and is protected by copyright and trademark laws. Unauthorized use is prohibited.

8. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Dispute Resolution

Any disputes arising from these Terms or our services will first be addressed through good-faith negotiation. If resolution cannot be reached, disputes will be resolved through binding arbitration in Travis County, Texas, in accordance with the rules of the American Arbitration Association.

10. Indemnification

Customer agrees to indemnify and hold harmless Lawn Care Austin TX, its employees, and contractors from any claims, damages, or expenses arising from customer's breach of these Terms or provision of inaccurate information about property conditions.

11. Governing Law

These Terms are governed by the laws of the State of Texas. Any legal action must be brought in the state or federal courts of Travis County, Texas.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

13. Entire Agreement

These Terms, together with any service-specific agreements and our Privacy Policy, constitute the entire agreement between customer and company regarding lawn care services and supersede all prior agreements or understandings.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a new "Last Updated" date. Continued use of our services after changes constitutes acceptance of the modified Terms.
